I wish. Unfortunately I'll have to point out all the reasons why it's unlikely.
The rights to the game would (approx 99.9% probability) have to be devoid of 40K universe elements (GW are very protective of it, and I can't imagine them letting a competitor anywhere near their IP), so that just leaves the rules.
Seeing as you can quite legally rewrite an almost identical set of rules as long as you tread carefully, that doesn't really leave anything to buy other than the name itself, and I can't imagine anyone wanting to spend the sort of money that'd likely be asked for to just get the name.
If the game is unable to use the 40K universe, it would have to use a different set of models. Not many companies would want to develop a set of models which only sell one set per customer - most production miniature economics (a notable exception being the smaller foundries that produce on a far smaller scale) is based upon each customer coming back and buying hundreds of miniatures to make up an army.
To be honest, it sounds like a perfect opportunity for someone to write up a brand new set of unofficial rules on a website, for everyone to download, print, and buy models to use with
Otherwise, theres far more chance of seeing it done by a company that isn't in competition with GW, and which could give a wider exposure to it - such as was done by MB Games in the first place due to the fact they were able to get GW IP into common toy stores.
