So sometimes to get access to a copy of some OGC you may have to buy a physical book. But then once you have that book you could re-type the OGC text and use it "freely" (i.e. without paying for the rights) in your own product.

So could you re-type the OGC (and only the OGC) and post it freely online?

As I understand it (I am not a lawyer) yes, as long as you included a copy of the OGL and sited references appropriately.

The confusion over 'free' is the same problem free software / open source have had to deal with. The free has two meanings: unencumbered and without cost, libre and gratis, or free as in speech and free as in beer. This is one reason called the OGL rather than a Free Gaming License.

In this case Mongoose pared the material from the TMB down into the TSRD and made it available at no cost. An alternative would have been to put a copy of the OGL in the TMB and have an extensive declaration of which bits are OGC and which bits are closed and what is PI. Then the first step to using the material would have been to buy a copy of the book.

I think we were talking more theoretically, rather than about one specific book. For example I could take the OGC from the Conan book and repost that if I wanted.

Dude, check out this thread from about a month ago. I explain the basics of the OGL, SRD and the TLL. Mind you, my guesses about what will and will not be in the SRD are a bit out of date now, but the all the stuff about the OGL/TLL are still relivant.
