ACTA Anihilation stalemate

It is possible that Anihilation game can not end becouse of sides unable to defeat one another. For example: Shadow Scout vs any fighter flight.
How do you determine who wins?
A. Stalemate=Draw
B. Count VPS, if equal then Draw.
C. Reroll scenario, becouse "If you cannot play a scenario for any reason (do not have the correct ships, Vorlons can not planetary assault, etc.) then re-roll on the table." But determining winner is not the same as playing...
D. Some other way?

A month now and still no official answer.
Don't you find such stalemate a problem?
