Space superiority scenario question

In a Space superiority game. If a shadow player kept his entire shadow fleet in hyperspace, which is allowed, but didn't bring anything on the board the first turn, does that cause an automatic loss? Since only 1 person has ships on the board during the end phase? Or could he theoretically keep them in hyperspace as long as he wanted till his opponent moved to where he wanted him to or some other situation?

So he can jump out on turn 12, all around battlefield, just to capture space?
By which time you'll no doubt have all the sectors covered, too... for a no score draw.

Sorry for hijacking the thread, one more question:
If there are ships still in hyperspace at the end of the game, are they worth any VPs to opponent?

And one more question similar, yet different:

If there are ships in hyperspace at the end of the game which can not enter the battle because the remaining ships are all destroyed or fled do they count for VPs?

I Matt ruled at a tournament once that any ships remaining in hyperspace (whether by choice or because they don't have an entry) count as making a tactical withdrawl.

Only issue with this is that the Shadows may jump out in all sectors but one with minimal presence and jump in the last one where the enemy only has a small ship etc destroy that one and win.

Very little will survive concentrated shadow beams. It's not a guaranteed win, but awfully close.
