From reading Matts answer the problem is not the making of any ships but the selling of them - if that is mentioned then MGP have a problem due to the licence and it being on their official forum?.

although I do second your idea - more ships is always good !
 
A question for Matt.
From what you say you could get into trouble for having people sell fan made ships via these forums, which is fair enough.
Would you have a problem with people making and showing ships on here?
If no, would you have a problem with people PMing the maker to ask if said person could make them a couple (maybe for a small fee) IF NOTHING ABOUT SELLING THEM WAS MENTIONED ON THE THREAD, only via PM or e-mail, as this wouldn't really be selling on the forums so you and mongoose should be ok.
As to be honest i have got some of Urobach's ships and do want more.
 
If it was done by PM or e-mail then Matt and Mongoose wouldn't know... unless they read all our PMs... which they are too busy to do ;)

No!

We _cannot_ know about it! If we hear about this going on then, whatever we may personally think, we _have_ to take action!

What you do in the privacy of your own homes, and what laws you choose to obey (or not) is nothing to do with us. But if we see sales of such ships going on (even if they are being sold at 'cost' or for 'goods'), then we are contract bound to do something about it.

I hope everyone gets where we are coming from here!
 
What about trading ships for ships? You said "goods", does that mean minis for minis? Just want a clarification :)
 
Sorry to weigh in on this, but I'm failing to understand why some people don't get this.

Due to the licencing you cannot produce and then sell or exchange for goods or services any model which can be tied to the Babylon 5 IP in any way.

It doesn't matter whether this is done via PM on a purely cost basis, it's still illegal!

It's also exceptionally unfair to put Matt and Mongoose in this position. They are trying to do the best they can for the users of this forum, without compromising their legal obligations to Warner Bros, and I think some people here are making that very difficult.

Please stop trying to 'get around' the license stuff and selling Babylon 5 linked/themed ships.
You are a superb modeller and scratch builder and I don't think you need to 'piggy back' an established license. Your stuff is good enough to sell itself.
I'd seriously look at the idea of doing your own range of ships and maybe your own ruleset.
I'm impressed enough with your designs that if the costs worked out ok I'd strongly consider stocking them at Hobbybox as a range of generic spaceships for use in things like Full Thrust.

This is just my 2 pence on the issue and not meant to 'get at' anyone, I just don't want to see people pushed into a corner, which is increasingly what is happening on these threads.

They really are making it difficult for themselves. A simple "forum rules" sticky thread would resolve everything. Instead we have endless wonderings and sub-questions, asking what is allowed and what is not allowed, and why some threads get deleted without explaination. Before this thread, we didn't know anything. This thread has established that it is the selling of scratch-built ACTA ships that is not allowed. But are we allowed to create them, paint them, show pictures on these forums and use them in our games (official tourneys or otherwise)? If so, are we allowed to give them ACTA stats, and names using WB's IP such as "Narn T'ka Ma'Sala" or "Minbari Bown Hedd"? Could someone create a replacement mini for an Adira, and show it off as such, as long as they weren't selling them? Are we allowed to sell Mongoose's own minis, on eBay or by forum post? Are we allowed to link to those auctions on these forums?

A forum rules thread wouldn't make it any less relaxed or make it any stricter. Nobody says you have to ban people for breaking the rules, in fact the current "punishments" (which are basically post or thread gets deleted, and in the worst case Matt PMs you telling you to play nice) can be kept the same. The fact is, there are boundaries and there are lines that are sometimes crossed, and thread/post deletions are sometimes necessary. It would be of benefit to all, to let us know what these boundaries are.

'For goods' means trading. It doesn't matter whether it is other minis or sheep.

Selling any spaceship on these Babylon 5 forums is implicitly saying 'this a Babylon 5 ship', whether you make mention of B5 or not, therefore it is contravening copyright as well as Mongoose's licence.
 
No I don't think you could copyright your ass, because we all have them. Unless yours is significantly different...
 
Selling or swapping Mongoose B5 ships on here is not illegal. You have bought those ships legally from Mongoose and they are yours to use as you see fit.

The issue is in using elements of the B5 universe to sell products which aren't Mongoose's.
