I would say yes. Killing an honourable individual who is helpless is a bad thing.
The rogue should think a bit more carefully before utterly disregarding the wishes of the guy with the huge axe who gets mad.
I think conan would have slain the rogue as a savage and a dishonourable fool.

to take an AoO you must threaten your target.
I can't think of any situation where if you threaten your target you would provoke an AoO by attacking them.

I asked my players and got an overiding "yes we like ongoing plots and badies" so I am building one in.

if you want to use the maps then there is plenty of scope in saying that the cartographers got it wrong. Mistakes in copying....
After all how many of the scribes that draw up the maps would ahve travelled the 500 miles to check.
Perhaps the original drawer wrote down the location from hear-say...
A lot of these issues would be easier solved by chatting with your players about the type of game you want.
Just get them around and say "I don't want everyone with clones. Lets think about what people want to play and how you want to spread the styles abilities and skills between you."

I like the repetition of reminder rules in - say - a monster reference. But the whole sale copying of a chapter from one book to another is not good.
e.g. Tito'#s slaves chapter and Messantia - slaves chapter. They are identical. It is not as if the rules are required as a reminder.
