What is the legality of selling this?

Before I report it, I want to know if it is in breech of the license.

What license would this even be in breach of? They are selling a product that was supposed to be given away on Free RPG Day. It wasn't, so now they are getting rid of it. Better than throwing it in the garbage, especially if someone is willing to pay that price. Heck, I'd sell mine for that kind of money.

I don't know, which was why I asked. For all I know it might have 'not for sale' printed on it.

I wouldn't really care if it was second hand, but selling it bagged just seems anti the principle of free rpg day... Not that I care all that much anyway.

Anyway, it seems okay... Not that I think it will sell at that price.

That would have no legal force with whoever owned it.
 
Wish 'em the best of luck - we sell it (minus the Free RPG Day logo) for less than $10 :)

On the ethical issue, I cannot see a problem with it. It was free on Free RPG Day, no reason for it to remain so. A guy has to make a living :)
 
For many people "after the event" listings on ebay are the only way to secure these free RPG day items; that's how I usually manage to get the ones I'm interested in. I've also sold a couple copies of WotC Game Day modules I ended up with after the fact; if someone else is a collector and I am not, more power to them.

I think selling Free RPG Day stuff would only be unethical if it was A: sold on Free RPG Day, and B: done by the participating retailer. I'm pretty sure retails are under some sort of agreement or obligation to fulfill their end of the process by handing out free product on that day. I know my FLGS continues to make the free stuff available until it is gone, which is nice of them...not sure if its a requirement, though, of their participation in the program.
 
Its been a while since I read the info, but the Free RPG Day stuff is not free to the vendors/Shops. They still pay for the product, granted not as much as it would truly cost, maybe, but stores do pay to participate. They had various packages, which were "X" number of boxes, each containing "X" amount of the products, so the store owners who were good at predicting their turn out wouldn't over spend.

I think it was three or so years ago when I read into all that, so I can definitely have things wrong. I am interested in getting corrected.
